Effective Date: 2/13/25
This Website Design & Care Plan Agreement (“Agreement”) outlines the terms under which NC Web Crafters (“Company,” “we,” or “us”) provides website design, development, hosting, and maintenance services to the Client (“Client”).
By submitting payment for website services, Client agrees to the following terms.
1. Payment Structure (Website Design)
A 50% deposit is required before work begins.
The remaining 50% balance is due prior to website launch.
All payments are non-refundable due to the custom and time-based nature of digital design and development services.
Work will not begin, and launch will not occur, until required payments are received.
Project timelines are estimates and may shift based on client responsiveness, content delivery, and revision requests.
2. Scope of Work
Website design services include:
- Custom website design
- Development and configuration
- Launch of up to seven (7) pages
Additional pages, features, integrations, or functionality outside the original scope require written approval and may incur additional fees.
Client is responsible for providing core business information, branding assets, and any required materials necessary to complete the project.
NC Web Crafters may assist with copywriting, layout recommendations, and basic graphic creation as part of the build process; however, final approval of all content remains the Client’s responsibility.
3. Revisions & Change Requests
Reasonable revisions during the build process are included.
Major structural changes, feature additions, or design shifts outside the approved direction may require a revised timeline and additional investment.
4. Website Care Plan (Hosting & Maintenance)
Upon launch, the Website Care Plan monthly subscription begins and renews automatically unless canceled in accordance with this Agreement.
By enrolling in the Care Plan, Client authorizes automatic recurring charges to the selected payment method.
Legacy pricing plans ($30 or $35) remain valid only while the subscription remains active and uninterrupted. If canceled or payment fails, legacy pricing eligibility is forfeited.
5. Payment Terms & Failed Charges (Care Plan)
If a payment attempt fails:
- Automatic retry attempts will be made.
- If payment is not successfully processed within seven (7) days, services may be suspended.
- Continued non-payment may result in website downtime until the account is brought current.
Client is responsible for maintaining a valid payment method at all times.
No refunds are provided for prior subscription payments.
6. Hosting Requirement
All websites maintained under this Agreement must remain hosted within NC Web Crafters’ managed hosting environment while maintenance services are active.
If the Care Plan is canceled:
- Hosting and maintenance services will terminate.
- The website will be taken offline at the end of the applicable billing period.
- Website files and a database backup may be provided upon written request.
Care Plan cancellations require thirty (30) days written notice.
Domain ownership remains with the Client. The Client is responsible for maintaining active domain registration.
7. Services Included in Care Plan
The Website Care Plan includes:
- Managed hosting
- WordPress core updates
- Theme and plugin updates
- Security monitoring
- Routine automated backups
- Website performance monitoring
- Minor content updates (text or image changes)
- Monthly website health report
Minor edits do not include structural redesigns, new feature development, or significant layout modifications.
8. Services Not Included
The following services require a separate agreement:
- Website redesigns or rebranding
- New functionality or custom development
- SEO strategy or ongoing optimization
- Email setup or troubleshooting
- Social media management or advertising
- Video hosting or large-scale file storage
9. Project Inactivity
If the website project becomes inactive for more than thirty (30) days due to lack of client communication, content, or approvals, a $250 reactivation fee may apply.
10. Ownership
Upon full payment of the website project, Client owns the website content and files.
NC Web Crafters retains the right to display completed work in portfolios, case studies, and marketing materials.
11. Limitation of Liability
NC Web Crafters is not responsible for delays or damages resulting from:
- Third-party service providers
- Client-provided content errors
- Hosting outages beyond our control
- Security breaches despite preventative efforts
- Circumstances beyond our reasonable control
NC Web Crafters shall not be liable for loss of revenue, business interruption, or indirect damages.
12. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina.
